1. Nectasia is not medical advice
Nectasia is a general wellness app. It is not a medical device, it does not diagnose, treat, cure or prevent any condition, and nothing in it is medical, nutritional or psychological advice.
Your calorie and nutrient targets are estimates. They come from standard formulas applied to the height, weight, age and activity you tell us about, adjusted by the pace you choose. Formulas describe averages, and you are not an average. Your real energy needs may differ substantially.
Talk to a doctor or a registered dietitian before you change how you eat, and especially before following any target Nectasia suggests, if any of the following apply to you: you are pregnant or breastfeeding; you are under medical supervision or taking prescribed medication; you have diabetes, kidney, liver, heart or thyroid disease; or you have, or have ever had, an eating disorder or a disordered relationship with food or exercise.
Stop using Nectasia and speak to a professional if tracking your food or weight starts to make you feel unwell, anxious or preoccupied. If you have a medical emergency, contact your local emergency services — do not rely on this app.
You are responsible for your own decisions about what you eat and how you exercise. We are not.
2. Who can use Nectasia
You must be at least 18 years old to use Nectasia. The app handles health information and sells subscriptions, and we are not set up to obtain or verify parental consent, so it is not for children or teenagers.
By creating an account you confirm that you are 18 or over. If we learn that an account belongs to someone younger, we will close it and delete the data held under it.
3. Your account
You can sign up with an email address and password, with Sign in with Apple, or with a Google account. Give us accurate details: the numbers Nectasia works out for you are only as good as the height, weight and birthday you enter.
Keep your sign-in details to yourself. You are responsible for what happens under your account. Tell us straight away if you think someone else has access to it.
One account per person. Please do not share an account with someone else — Nectasia builds a picture of one body over time, and two people in one account produces advice that suits neither.
4. AI estimates, and their limits
When you photograph a meal or describe it in words, Nectasia sends it to an artificial-intelligence service to work out what the food is and roughly what is in it. This is an estimate produced by a machine. It is often close and it is sometimes wrong, about the food, the portion size, or both.
Never rely on Nectasia to tell you whether a food is safe for you to eat. It cannot reliably identify allergens, traces, or ingredients hidden in a dish. If you have a food allergy or intolerance, check the label or ask the person who prepared the food.
Nutrition figures also come from public and licensed food databases, which contain errors of their own and vary by country and brand. Where accuracy matters to you, check the packaging and correct the entry — you can edit anything Nectasia records.
5. Subscriptions and payment
Some features require a paid subscription. Subscriptions are sold and billed by Apple through the App Store, not by us. The price, the billing period and any free trial are shown to you before you confirm, and you pay in your App Store account's currency.
- Subscriptions renew automatically unless you cancel at least 24 hours before the current period ends.
- Your account is charged for renewal within 24 hours of the end of the current period.
- You can cancel, or turn off renewal, at any time in your store account settings. Cancelling stops the next charge; it does not shorten the period you have already paid for.
- If you start a free trial and then subscribe, any unused part of the trial is forfeited.
Refunds are handled by Apple under its own policy, and we cannot issue them ourselves. If you want a refund, request it through Apple. If you believe you were charged in error, write to us anyway and we will do what we can to help.
We may change what a subscription costs or what it includes. If a change affects a subscription you already hold, you will be told before it takes effect and you can cancel before it does.
6. Using Nectasia properly
Nectasia is licensed to you for your own personal, non-commercial use. Please do not:
- copy, resell, rent or redistribute the app or anything in it;
- reverse engineer or decompile it, except where the law says you may;
- access it by automated means, scrape it, or use it to build a competing dataset or service;
- work around usage limits, or use the AI features for anything other than logging your own food;
- upload anything unlawful, or any photograph of another person who has not agreed to it.
7. What you put in, and what we may do with it
Your photos, diary entries, weigh-ins and notes remain yours. You give us permission to store and process them for one purpose: running Nectasia for you. That includes sending a meal photo or description to our AI provider so it can be analysed, and keeping your history so the app can show you a trend.
We do not sell your content and we do not use it to advertise to you. We may use information that has been aggregated or stripped of anything identifying you to understand how Nectasia is used and to make it better.
The app itself — its software, design, name and written content — belongs to us or to those who licensed it to us, and stays that way.
8. What you can expect from us
We will make a reasonable effort to keep Nectasia running and to keep your data safe, but we cannot promise it will always be available or free of faults. Nectasia is built and maintained by one person, and it depends on services we do not control.
We may add, change or withdraw features. If we withdraw something you paid for, or stop the service altogether, we will tell you and, where it is fair to do so, refund the unused part of your subscription.
9. Ending your use of Nectasia
You can stop using Nectasia whenever you like, and you can delete your account from within the app. Deleting your account removes your data as described in our Privacy Policy. Deleting the app from your phone on its own does not delete your account, and does not cancel a subscription — cancel that in your Apple account settings.
We may suspend or close an account that breaks these terms, that is being used to harm the service or another person, or that we are required by law to close. Unless the law prevents it, we will tell you why.
10. Responsibility and its limits
Except for anything we have expressly promised in these terms, Nectasia is provided as it is, without warranty of any kind. We do not warrant that its estimates are accurate, that it will suit your purpose, or that it will be uninterrupted or error-free.
To the extent the law allows, our total liability to you for any claim connected with Nectasia is limited to what you paid us in the twelve months before the claim arose. We are not liable for indirect or consequential loss, or for loss of profit, data or opportunity.
Nothing in these terms limits liability that cannot lawfully be limited — including liability for death or personal injury caused by negligence, or for fraud — and nothing in them takes away rights you have as a consumer that cannot be signed away.
11. About Apple
This agreement is between you and us, not between you and Apple. Apple is not responsible for Nectasia or its content, and has no obligation to provide you with support for it. If Nectasia fails to conform to any applicable warranty, you may tell Apple and Apple will refund the purchase price; beyond that, Apple has no other warranty obligation for the app.
We, not Apple, are responsible for dealing with any claim about the app — including product liability, any failure to meet a legal requirement, and any claim under consumer protection law — and for any claim that the app infringes someone's intellectual property. Apple and its subsidiaries may enforce these terms against you as a third-party beneficiary.
You confirm that you are not located in a country subject to a United States government embargo, and that you are not on any United States government list of prohibited or restricted parties.
12. Changes to these terms
We may update these terms as Nectasia changes. The date at the top tells you when they last changed. If a change matters to you — anything affecting your rights, your money or your data — we will tell you in the app or by email before it takes effect.
If you keep using Nectasia after a change takes effect, you accept the updated terms. If you would rather not, you can stop and delete your account.
13. Which law applies
These terms are governed by the law of the Hong Kong Special Administrative Region, and the courts of Hong Kong SAR have jurisdiction over any dispute.
If you are a consumer living in the European Union, the United Kingdom, or anywhere else whose law says otherwise, this does not take away the protections your own law gives you, and you may bring proceedings in the courts of the country you live in.
